试论反邪教法的理论瓶颈及其突破--兼评《邪教的法律治理》

摘要

Is heresy one of religions Is anti-heresy in conflict with religion freedom ?How can a satisfactory so-lution be found if there is no conflict between them .These problems are theoretic bottlenecks of anti-heresy law and also are a weak side in the international struggle of anti-heresy .Based on the evaluation standard of religious realities ,Legal Governance of Heresy by Liu Zhenfeng and Zhou Xinguo ,putting forward three points:realities of heresy ,limited freedom of international religious freedom and legislative proposal for anti-heresy law ,has overcome three theoretic bottlenecks of anti-heresy law and promoted the study of anti-heresy law .%邪教是否属于宗教？反邪教与宗教信仰是否冲突？如果两者不冲突又如何实现两者的“两全”？这些是我国反邪教法的理论瓶颈，也是我国在反邪教国际斗争中的软肋。刘正峰、周新国两位教授合著的《邪教的法律治理》在宗教事实评价标准基础上提出的邪教事实宗教说、国际宗教自由有限自由说及其反邪教立法建议，突破了我国反邪教法学的三大理论瓶颈，极大地推进了我国的反邪教法研究。
