我国证据法学的变革、移植与创新--兼论艾伦教授文集与张保生教授主编之《证据法学》

摘要

The law and the science of law change and transplantation are the mainline of reform and modification of laws since Chinese legal system construction and development in the late Qing.Evidence law and the science of evidence law are of no exception.Evidence Law edited by Professor Zhang Baosheng has been pursuing Chinese evidence law theory system and academic reform and innovation.In the process,he innovated the academic thoughts of Ronald J Allen,Professor of Law School,Northwestern University of America.In the positioning of evidence law,attribution of evidence,exclusion-ary rule of evidence,the burden of proof and standard of proof and so on,it reflects the relationship of cooperative trans-formation and the development of transplantation.Especially through plenty of transplantation and improvement the self-innovation has been realized.%法律以及法学的变革与移植，是清末变法修律以来，中国法制建设与发展的主线。证据法与证据法学亦不例外。张保生教授主持编写之教材《证据法学》，一直追求对中国证据法学理论体系与学术主张的变革与创新。在此过程中，他对美国西北大学法学院威格莫尔特座教授罗纳德·J·艾伦的学术思想在引进和移植的基础上进行创新。中美证据法学在证据法的定位、证据属性、排除规则、证明责任和证明标准等方面，都体现出变革与移植的协同发展，特别是通过大量移植实现了中国证据法学的自我创新与完善。
