我国能源立法监管问题研究--基于美国能源法的比较分析

摘要

In August 4, 1977, America through"National Energy Law"in the Carter era, the energy law has been recognized internationally as a special term. With the development of society and economy, American formed to energy production and efficiency, the national security and the environment as the core energy policy, the USA become the example of international community energy legislation management in energy legislation. China's energy law system is not complete, there is deviation between the legislative purpose and processing energy use and environmental protection. To solve this problem, we need to reconsider, position energy legislation purpose and value orientation.%1977年8月4日，美国在卡特时代通过《国家能源法》，从此能源法逐渐被国际社会认同为一个专门的术语。随着社会经济的发展，美国形成了以能源生产和效率、国家安全和环境为核心的能源政策，使美国在能源利用立法方面，成为国际社会能源利用立法管理学习的榜样。我国能源法体系尚不完备，在立法目的和处理能源利用与环境保护的关系之间存在偏差。要解决好这个问题，就要重新思考、定位能源立法目的及其价值取向的选择。
