海南非物质文化遗产立法保护探析

摘要

海南是个少数民族聚居及少数民族非物质文化遗产品类繁多的地区,2011年中国在国家范围内颁布了非物质文化遗产保护法,是非物质文化遗产在国家层面获得法律保障,但海南省目前具有可操作的地方立法仍然匮乏,立法机构应加强这方面的立法工作,在立法时使相关的地方立法与上位法原则保持一致、突出少数民族地方特色,并使地方立法具有更强的操作性.%Intangible cultural heritage is rich in Hainan province. Hainan province is still lack enough workable local legislation, the legislature should strengthen the legislation work, makes relevant local legislation in the legislative process and keeps it in line with the superior legal principle, highlight the local characteristics of the ethnic minorities, and makes the local legislation has stronger operability.
