本文主要就近年来日本社会关于夫妇别姓论的争论进行研究。夫妇别姓论提出10年以来，赞成派和反对派分别各执己见。2011年2月22日，五名日本人因不满日本民法中规定结婚时一方必须改姓的制度，向东京法院提起诉讼。由此可见，日本现行的夫妇同姓制度的改革已经成为了亟待解决的问题。本文将围绕关于夫妇别姓论的争论，就同姓制度的发展，争论的焦点以及日本国民对夫妇同姓制度的看法作出论述。%This article focuses on the controversies that have appeared in recent years over the institution of changing family names after marriage in Japan. Consensus has not been reached between supporters and opponents since this issue was put forward ten years ago. On February 22nd, 2011, five Japanese took legal proceedings to the Tokyo court against the stipulation in Japanese civil law that a woman must change her family name to the husband’s upon marriage, which reflects the urgent demand for the reform of this stipulation. This paper focuses on the debates over the current social institution of changing surnames after marriage, and discusses these from three aspects:the development of the same-surnamed institution, the focus of the controversies, and the public’s view on the institution of changing surnames after marriage.
