With the development of S＆T and the medical technology innovation, the transgender has gradually become a common occurrence in our society. Regarded as a special social group, the transgenders posed to the problems of increasing legal disputes and moral hazards. Laws and regulations should and appropriately respond to citizens＇ freedom of transgender.%科技的发展，医疗技术的革新，使公民改变性别的自由这一问题逐渐进入人们的视野。改变过性别的公民就成为一个不容忽视的特殊社会群体，由其改变性别而引发的法律纠纷和道德风险也日益增多。法律对公民改变性别的自由应该理性对待，做出相应的价值选择。
