监狱刑嫌调控的模式迁移与侦查原理

摘要

In order to regulate the prison base investigation business,improve control and accuracy detection against the performance of re-offending in prison,the investigation critical control system in prison should turn to the criminal investigators suspect and control mode;prisons should follow the relationship between the basic investigation and the investigative techniques,the conditions of the prison sentence positioning mode,the detection mode ＂from the human to case ＂,and other diversified operating rules,to embody the detection principle in the criminal suspection including material exchange,the same identification,cause and effect relationship and information control.%为规范监狱侦查基础业务,提高监狱准确控制与打击押犯再犯罪的侦查效能,针对当前重危犯查控制度的主要弊端,比较刑嫌调控所固有的以＂人＂为中心的犯罪预测与情报侦查等功能,监狱重危犯查控制度应向刑嫌调控侦查模式迁移;监狱应遵循侦查基础同侦查手段之间的关系模式、监狱刑嫌调控的条件定位模式、＂从人到案＂等多元化侦查模式的运行规则,以此体现刑嫌调控中的物质交换、同一认定、因果关系、信息控制的侦查原理。
