试论巴泽尔的产权保护思想

摘要

The function of property rights is the concision of Barzel’s thoughts of property rights protection. He discusses his thoughts of property rights from three aspects:other’s grabbing(QG)、self protection(SP)and government protection(GP). Undoubtedly,seeking to maximize the value of rights is the fundamental reason for individual grabbing behaviors,protective behaviors and continuous marginal adjustments behaviors. One situation of other’s grabbing is to seize the property value that clearly belong to other’s or in the public domain during the market transactions. And the other situation is to seize other’s property during the non-market transactions. The methods to protect the personal property rights are to reduce the value that entered into the public domain or grabbed by others from the public domain,further to impose restrictions to avoid infringing each other’s rights. What’s more,States have responsibility to assist individuals protecting their property and prevent other’s grabbing. However,government also spends money to protect property rights so the purpose of necessary government restrictions is to reduce the costs of protection.%产权函数是巴泽尔对其产权保护思想的凝练，从他人企图夺取（QG）、自己努力保护（SP）和政府予以保护（GP）三个方面，巴泽尔系统论述了关于产权保护的思想。而追求权利价值最大化，无疑是个人进行攫取行为和保护行为并不断进行边际调整的根本原因。他人企图夺取的一种情形是在交易中侵占明确分割给对方的以及进入公共领域的属性价值，另一种情形是在非市场交易中侵占非其所有的财产。个人保护产权的方法是减少进入公共领域内的价值或者降低公共领域内被他人攫取的价值，并通过施加限制避免相互之间的侵权行为。国家有责任辅助个人保护自己的财产，防止人们染指非其所有的商品属性。但政府保护产权也要花费成本，必要的政府限制旨在减少保护费用。
