申冤、无辜者计划及其推进策略

摘要

A huge number of wrongfully decided cases and too many difficulties in redressing these cases are the reality in contemporary China.Whether succeed or not in redressing inj ustice depends on all kinds of accidental factors,such as the composition of many pivotal factors like the parties'efforts,the attorneys'expe-riences,the experts'witness,key evidences,self-media and the courts'work in Nianbin's Case.However, this kind of composition of factors is merely a necessary condition rather than a sufficient condition on the way to j ustice.Referring to the Innocent Proj ect of the U.S.A,our public interest organization BIGCASE launched an action program - the Innocent Proj ect,whose work includes setting up a database of unj ust cases,filtra-ting unj ust cases and providing some legal assistance.The main promoting strategies of the Innocent Proj ect are:making use of self media,making clear of the problems,taking the advantages of uncompromised law-yers and performance art.We try to use individual cases to push the rule of law and strengthen cooperation of other organizations and people.%冤案多，申冤难，是当下中国的现实。申冤是否成功关键在于各种偶然因素之合力，正如念斌案的平反取决于当事人、律师、专家、关键证据、自媒体、法院等诸多关键要素的合力。但合力只是通往正义的必要条件，而非充分条件。参考美国的无辜计划(Innocence Proj ect)，依托大案公益平台，发起了一个公益行动项目———无辜者计划。无辜者计划的主要工作包括建立冤案数据库，筛选冤案，法律援助。无辜者计划的推进策略是充分利用自媒体、呈现问题、利用死磕与行为艺术、个案推动法治、加强合作。
