期刊责任编辑身份权相关问题及建议

摘要

From the perspective of management,the demand of the executive editor's signature was once regarded as a display of the editor's responsibility,while now from the side of the executive editor,it is a reflection of personal value and an honor as well.The executive editor's signature is a proof of their identity rights.Just as the right of authorship,executive editors have their right of identity,and it should be protected.The lack of executive signature,the signature on the footer of the content page,the use of abbreviation of editor's name and the disqualification of the executive editor are taken as infringement on the editor's identity rights.The demand of the signature of executive editor should be added to the related law or regulation,and measures be taken to the implementation of the rule.%以往的研究或期刊编辑部要求期刊责任编辑署名，更多的是认为责任编辑需对其所编辑的文章负责，是站在管理者的角度出发的；而站在责任编辑的角度则认为还可以是其价值的体现、是一种荣誉。其实责任编辑文后署名更是对其身份权的认同。就像作者对其创作的作品拥有署名的权利一样，责任编辑对其所编辑文章也有在作品后署“责任编辑 XXX”的权利。这种权利就是期刊责任编辑身份权，应该受到保护。目前存在责任编辑文后不署名；责任编辑汇总在目次页脚；责任编辑署笔名或中文拼音首字母缩写名；文后署名的责任编辑不具备出版专业资格等侵犯期刊责任编辑身份权问题，当前可借用其他法律来实施，而有关部门亦需把责任编辑在其编辑的文章后署名的条文写进相关法律、管理条例或法规制度中，并制定必要的监督机制来落实。
