“排除合理怀疑”标准的适用需要司法判例

摘要

The introduce of"beyond a reasonable doubt "standard into Chinese judicial field is a beneficial ex-ploration .However , the fact that it has trouble in interpreting words , lacks the way to distinguish different applica-tion standards , and is hard to apply the testing means to the practice asks for urgent experience and solution out of judicial cases .And since judicial cases share such characteristics as homology , complementarity and international-ism with the standard above , they will go a long way toward the application of the "beyond reasonable doubt"standard .%“排除合理怀疑”标准的引入是我国司法领域一种有益探索。然而由于”排疑”标准存在词语解释困难、标准适用缺乏区分、证明方法在实践中运用困难等原因，亟需从司法判例中寻求经验和解决方法。司法判例与“排除合理怀疑”标准具有同源性、互补性与国际性，运用司法判例辅助”排疑”标准的适用也具有极高的可行性。
