工具型网络犯罪的实证分析与刑事政策应对

摘要

网络新时代的到来使得传统犯罪急剧异化.工具型网络犯罪是利用网络创造便利或条件,并借此实施犯罪,近年来这类犯罪日益严重,且明显呈团伙化,其可分为网络财产犯罪、网络交易犯罪、网络经营犯罪等具体类型.司法实践中,对此类犯罪的处理存在共犯认定不统一、刑罚适用标准不尽合理、具体罪名认定不尽合适、新型违法行为定罪不足等问题.为有效应对此类犯罪,我国应及时调整相关刑事政策,增加或变更刑事立法,统一司法标准,正确发挥刑罚的作用.%The arrival of the internet era has brought the rapid alienation to the traditional crime.Tool-type cyber-crime, referring to those crimes exploiting the network, is becoming more and more serious and organized in recent years.Tool-type cyber-crime could be sorted as property-crime, transaction-crime and cyber management-crime, etc.Such crimes are not processed so well in judicial practice.Problems could be found in the cognizance of complicity, the standard of punishment, the identification of specific crimes, the conviction of new offences and so on.To deal with this situation, we need to adjust our criminal policy, reform the criminal legislation, unify the judicial standard, and apply the criminal punishment more correctly.
