对后危机时代加强国际金融监管合作的思考

摘要

Due to the frequent outbreak of the international financial crisis, many countries are aware that it is necessary to strengthen international cooperation in financial supervision; however, the current cooperation is unreliable as it lacks proper policies and mechanisms. The stability and development of the international financial system depends on the establishment and improvement of legal systems for international financial supervision, which should be built at two levels： making multilateral international treaties to strengthen international cooperation in financial supervision; having international cooperation in some degree by making and implementing soft laws in certain financial supervision field in which international treaties can not be made in shot run.%频繁爆发的国际金融危机使各国都意识到应该加强金融监管国际合作，然而松散的、缺乏制度建设的金融监管国际合作并不可靠，国际金融体系的稳定与健康发展必须依靠国际金融监管法律制度的建设与完善。应该在两个层面上构建国际金融监管合作的法律制度：第一个层面是制定加强金融监管国际合作的多边国际条约；第二个层面是在某些难以短期内达成国际条约的金融监管领域，通过制定和实施软法的方式，实现一定程度上的国际合作。
