短语类作品版权保护的困境与进路——以'我叫MT'案为切入点

摘要

短语类作品是指由基本语言单位组成的简短作品.限于表达量,各国对短语类作品的版权保护均采取保守态度.独创性的认定是短语类作品版权保护的关键.短语类作品的版权保护存在着天然的制度风险.因而,有必要在研究各国现有规定的基础上,辅之以案例研究,为短语类作品版权保护提供可资借鉴的路径.%The short phrase work refers to the kind of short work which only consists of basic units of language.Limited by the expression amount, lots of countries take a conservative attitude on the copyright protection of the short phrase work.The key problem of copyright protection on the short phrase work is how to identify its originality.There are some natural economic and institutional risks in the copyright protection of short phrase work.Therefore, in order to provide a better way for the protection on the short phrase work in our country, it is necessary to analyze the legislation and judgment of other countries.
