“七天无理由退货”条款之理性反思与限制适用--以网络拍卖经营方式为研究对象

         

摘要

“七天无理由退货”条款是否可适用于网络拍卖之中,取决于消费者之权益与拍卖机制之维持间的利益博弈。从利益上衡量,网络拍卖制度本身的存亡不仅关系到经营者的合法权益,更为重要的是,将影响到广大参与竞拍过程的其他消费者之合法权益。竞价机制的存在比消费者权益的保护可能更为重要,它应当构成限缩《消费者权益保护法》第二十五条之适用范围的充分理由,而将“网上拍卖”排除于“无条件退货权”的规范射程之外。%Whether seven-day unconditional return article can be applied in network auction depends on the maintenance of the rights and interest struggle between the consumers and the auction organizations. The survival of the network auction system itself is not only related to the legitimate rights and interests of operators, and more importantly, it will affect the other legitimate rights and interests of consumers in the process of participation in the auction. The existence of the bidding mechanism is more important than the protection of consumer rights and interests. It constitutes the reason to apply the article 25 “consumer rights and interests protect a law”, and it excludes “online auction” beyond the standard range of “unconditional right of return”.
