竞业禁止和自主择业权的冲突与协调

摘要

As the rapid development of economy,science and technology,the trade secret as the enterprise core competitiveness the key elements of growing market attention of subject,and worker＇s rights to some extent were unreasonable restricted.This paper,combined with the system of our country discussed,how to realize the balance of the interests of all parties,to perfect our system of non-competition,reduce unreasonable talent flow caused by the loss of business secrets,maintain reasonable market competition order,promote the harmonious development of socialist market economy.%随着经济和科学技术的迅猛发展,商业秘密作为企业核心竞争力的关键构成要素日益受到市场主体的重视,而劳动者的相关权利一定程度上却受到不合理的限制。在现有的国情下,只有实现各方利益的平衡,完善我国的竞业禁止制度,减少不合理的人才流动所造成企业商业秘密的流失,维护合理的市场竞争秩序,才能促进社会主义市场经济和谐发展。
