我国土地征收问题及改革方向探索

摘要

As the only way of non-agriculturalization of farmland, land requisition is of great significance for the formation of industrialization and urbanization.From three aspects of public interests, administrative operation processandland compensation, it was found that there are many problems in land requisition in China, including unclear range of public interest, unstandard administrative operation process of land req-uisition, low compensation standard, which leads to the conflict of land expropriation and is not conductive to the stable development of the so-ciety.The reformation direction for land requisition in China was proposed :perfecting land requisition connotation,determining scope of public interests; regulating land requisition process; appropriately improving the existing land requisition compensation price ; doing a good job in landless peasants resettlement work.%土地征收作为我国农地非农化的唯一途径，对于工业化和城市化的形成具有重要意义。该研究分别从公共利益目标、行政操作过程、土地补偿3个方面出发，发现目前我国土地征收存在着公共利益范围不明确、土地征收行政操作过程不规范、土地征收补偿标准较低等问题，进而导致征地冲突等矛盾，不利于社会的稳定发展。提出了今后我国土地征收改革方向：完善土地征收内涵，明确公共利益范围；规范土地征收操作过程；适当提高现有土地征收补偿价格；充分做好市民化后失地农民的生活安置工作。
