“两个证据规定”实施情况调研报告——侧重于三项规定的研究

摘要

The two evidence acts supports the eager expectations of perfecting the criminal evidence sys- tem and boosting fair trial of the public. The implementation status has been being remarkable since its implemen- tation from July 1,2010. This paper takes four intermediate people＇s courts as research objects, and makes an in- vestigation of the implementation status of the two evidence acts. The empirical research methods include inter- view, case files review and so on. As for the theme, it focuses on three provisions： the exclusion of illegal evi- dence, the use of covert evidence and the use of special investigation evidence.%＂两个证据规定＂承载着社会各界对完善刑事证据制度、推进公正审判的热切期望,自2010年7月1日实施以来,其实施状况颇为引人关注。本文以四个中级人民法院为研究对象,对中院适用＂两个证据规定＂的情况进行了调研,通过运用访谈、阅卷等实证研究方法开展研究。就研究主题而言,选取了＂两个证据规定＂中的三项规定进行重点研究,其分别是非法证据排除规定、隐蔽性证据的使用问题以及特殊侦查措施取得的证据的使用问题。
