建筑遗产保护从资格审查到行为审查法律研究--《纽约城市地标法》的启示

摘要

The core of the architectural heritage protection is the authenticity of architectural heritage protection and thus of architectural heritage in the changes and reconstruction, and damage to small construction control and punishment is the core of architectural heritage. If not effectively controlled, architectural heritage once it has been illegally modified, demolished, its historical significance will be lost, and cannot be remedied. < New York City Landmark Law > should be used for reference, strictly on the architectural heritage building, change, demolition control, from qualification examination to changes in the behavior of review.%保护建筑遗产的核心是保护建筑遗产的原真性，因而对建筑遗产进行改动、重建、损毁以及小型工程的控制和处罚是建筑遗产法的核心。如果没有有效的控制，建筑遗产一旦被非法改造、拆毁，其本身的历史意义就会丧失，而且无法补救。应借鉴《纽约城市地标法》，严格对建筑遗产建造、改动、拆毁的控制，从资格审查向行为审查转变。
