“抵触”控制:介于合法与违法之间的管理——以美国区划法规中的“抵触”控制规则为例

     

摘要

随着我国城市建设速度加快,作为城市建设管理核心的控规以及各类技术规范均处于不断优化调整中.这就导致—个问题,即某项开发,其在建立时合法,但后来由于控规或规范自身的调整,导致开发与更新后的控规或规范不符.对于这类现象如何界定?对其今后进一步延续、改造、扩张、重建等问题如何管理?这在我国城市建设管理体系中一直处于摸棱两可状态.美国区划法规拥有近百年的历史,且一直处于持续调整过程中,对于上述现象积累了丰富经验并形成了完善的“抵触”管理规则,既体现了对私有财产的重视,又体现了对区划法规自身延续性和严肃性的尊重.本文通过对美国区划法规的解读,为进一步完善我国城市规划管理体制提供借鉴.%Along with the accelerated urban development of China, the regulatory plans as the core of urban development management and the various kinds of techniques and standards are in constant adjustment. This leads to a problem, i.e., a development project was legal at its establishment, but later it became inconsistent with the regulatory plans or standards due to the adjustment of the plans or standards. How to define this phenomenon and control its expansion, reconstruction and other issues? The zoning regulations in the United States has accumulated rich experience and formed a set of complete management rules for "nonconformities," which reflects not only the emphasis on private properties, but also the respect for the continuity and seriousness of zoning regulations. Through the introduction and explanation of zoning regulations of the United States, this paper hopes to provide a reference for the further completion of the city planning administration system in China
