国际足联善治的法律解读

摘要

The corruption in FIFA demonstrated that there existed some governance problems within FIFA,it should reform its internal regulations and decision making process based on the principle of good governance.While stressing the autonomy of sports organizations,it would not neglect the general principles of law and domestic mandatory rules.It should set up trans-parence and accountability regulations as well.The football-related awards made by CAS also demonstrated that there should be some limitation on sports autonomy.%国际足联出现的腐败等丑闻表明，国际足联的治理出现了某些问题，需要在遵守善治的原则上逐步改革自己的治理体制，在强调自治权的同时不能违反有关国家法律和一般法律原则的强制性规定，要建立公平的透明机制，以及制定完善的问责机制等。国际体育仲裁院受理的一些有关国际足联治理的争端也表明，体育组织自治权的行使是有限制的，要在遵守善治原则的基础上进行体育管理。
