论海事行政许可裁量权的内部控制：基本理念与制度构建

摘要

This paper, Based on the analysis of the basic concept of Maritime Administrative Licensing Discretion (MALD), provides the proposal that the necessity of enhancing internal control lies in improving maritime sector and personnel’s executing responsibilities actively, ensuring the rights and interests of the counterparts and promoting the construction of“MSA in sunshine”and“MSA under the rule and regulation”. The standardization of MALD will be realized by means of drawing up “administrative methods of MALD”, “discretion standards of MALD” and other supporting systems.%基于海事行政许可裁量权的内部控制基本理念分析，加强内部控制的必要性在于督促海事部门和人员积极履责、保障相对人合法权益以及促进阳光海事、法治海事建设。通过制订“海事行政许可裁量权管理办法”、“海事行政许可裁量基准”、“裁量权内部控制的配套管理制度”和“执法人员行政伦理教育机制”，实现对海事行政许可裁量权的规范。
