从近代世界经济发展的格局看，世界经济中心经历了从意大利到英国、法国，再从德国到美国的转变，相应地世界科技中心也发生了转移。在世界科技中心的转移过程中专利立法及专利保护起到了至关重要的作用。本文从对专利保护－科技发展－经济进步三者的辩证关系进行思考，并根据世界历史发展结合逻辑推理推导出三者之间的逻辑关系，即专利保护有利于促进科技发展和经济进步。之后就中国专利立法及实践领域的问题给出建议，以利于通过加强专利保护从而推进中国科技、经济发展。%During several hundred years,the economic center of world has shifted several times, from Italy to England to France to Germany,and then to the United States. Accordingly,the world center of science and technology has taken place in similar trend. In the transfer process of the world science and technology center,patent legislation and patent protection played a crucial role. In this paper,we considered and deduced the dialectical relationship among patent protection,technology and economic development,that is,patent protection is conducive to promoting scientific and technological development and economic progress. In order to facilitate the development of science and technology in China,we also give some suggestion for patent legislation by strengthening patent protection.
