网络交易消费者的个人信息保护

         

摘要

新修订的《消费者权益保护法》就经营者收集消费者个人信息应履行的法律义务以及违反相关义务需承担的法律责任等内容进行了规定,对保障消费者个人信息安全具有十分重要的意义。然而,相关法律条文规定得相对比较原则,且针对的是一般消费行为,对电子商务环境下个人信息保护的特殊性并未加以特别关照,因而需要在借鉴国外立法成熟经验基础上加以进一步细化,以增强法律的可操作性与针对性。具体而言,一要构建个人信息权利内容体系,主要包括信息收集知情权、信息收集选择权、信息控制权、信息安全请求权等方面的内容;二要明确电子商务经营者的个人信息保护义务,主要包括信息收集、信息使用、信息安全保障义务等三个方面;三要完善个人信息侵权法律责任制度,从民事、行政、刑事等三个方面入手使个人信息获得全面保护。%The newly revised Consumer Protection Law stipulates the legal obligation and responsibility of operators in collecting personal information of consumers,which is of great significance for guaranteeing consumers’ personal information safety. While the relevant legal provisions are too principle and only aiming at normal consumer behavior;it did not pay special attention to personal information in the context of e-commerce. So, we should make it to be more detailed and to be more operational and targeted based on learning from the experiences of other countries. Specifically, we should, first, construct the content system of personal information right, such as the information right of knowing, choosing, controlling and safety claiming; second, we should clarify the obligation of e-commerce operators in protecting personal information in terms of information collection, usage and safety guaranteeing; and third, we should improve the personal information tort liability system and protect personal information in civil, administrative and criminal aspects.
