B2C 模式下的自贸区跨境电子商务法律问题研究--以“跨境通”平台为切入点

上海自贸区的建立，对于推动我国经济及跨境电子商务等新型贸易的发展大有裨益。跨境电子商务作为新型国际贸易样态，具有传统国际贸易及“海外代购”所不可比拟的优势。在这样的趋势下，由政府主导的跨境电子商务平台———“跨境通”应运而生，其具备的功能价值更多地体现在境外商家与国内消费者之间的贸易交往上。因此在 B2C 模式下以“跨境通”平台为切入点，可以更好地分析自贸区跨境电子商务存在的诸如消费者权益保护欠缺、法律证据不足、管辖制度缺失以及纠纷机制落后等法律问题，并有助于为今后的跨境电子商务平台作出法律完善建议。%The establishment of the Shanghai Free Trade Zone is good for our headquarters economy and the development of cross-border commerce.As a new mode of international trade,cross-border commerce has incomparable advantages over the traditional international trade.Kua Jing Tong is a government-dominated cross-border commerce platform which cropped up in this trend.It fulfills the function as the connection between foreign companies and domestic consumers.With this platform,we can better understand such issues as the lack of consumer protection,the lack of legal evidence and the lack of jurisdiction system and the mechanism to settle disputes.It will be beneficial in improving legal environment of cross-border commerce.
