单位犯罪意志的形成机制研究

摘要

The punishment of fine which is sentenced to unit in essence is aimed at the interest groups which are behind in unit.In the process of unit crime cognizance , if we abandon the crime will of interest group while maintain to the unit crime , it will undoubtedly violate responsibility principles.When interest group is inconsistent with decision makers , crime will do not directly reflect the will of unit crime but the will of personal crime.The formation mode of unit crime will is only one kind——selection of unit institution and unit decision based on interest group.%单位罚金刑在本质上是对单位背后的利益者群体的刑罚处罚,在认定单位犯罪过程中,脱离了利益者群体的意志认定单位故意犯罪,势必与责任主义原则相违背. 决策者群体意志与利益者群体意志完全分离时,单位决策者群体的犯罪意志不能视为单位的犯罪意志,而只能视为单位决策者群体的个人犯罪意志. 就单位犯罪意志的形成方式而言,其形成方式只有一种——基于利益者群体意志对单位制度、单位决策的选择.
