This study asks the question why are there not more women labor arbitrators? Using a multi-disciplinary theory it approaches the problem by 'asking the woman question' as the basis of an analysis of archival data of arbitrator biographical characteristics and selection. Through an empirical analysis of eight years (fiscal 1987 through fiscal 1994) of archival data of nominations and selections of over 1600 individual labor arbitrators from the Federal Mediation and Conciliation Service, it attempts to determine the validity of the myth that the reason there are so few women labor arbitrators (less than 175 women nationwide, or 11.7% the total national pool) is because they are less experienced and have fewer of the characteristics which parties look for when choosing an arbitrator. The findings are that the biographical characteristics and backgrounds of male and female arbitrators are very similar for those in the pool, and female arbitrators have similar expectations of being selected as the men. However, the factors predicting arbitrator acceptability are very different for men and women. This means that the myth that all women must do is "look" like the men to be selected as arbitrators is not true. It also means that the training programs to help women get exposure and experience in arbitral processes intended to help them be accepted as arbitrators are misdirected. From an analysis of these findings, the author recommends an expansion of the experiential biographical information provided to selectors so that it encompasses the broader breadth of background many women have but which cannot be shown a in traditional resume format. It is hoped that this will enhance the possibility that arbitrator selection criteria will focus on those traits parties claim to want and will open the arbitral profession to greater participation by women.
