A new proposal for the Brazilian mining environmental regulation system

This paper introduces a new proposal for the environmental legislation, which regulates the Brazilian mining operations. The system in use is inefficient, requiring adjustments to ensure better results for both the community and industry. This study is structured as follows: ⅰ. evaluation on the bureaucratic structure, including documentation procedures as well as their analysis; ⅱ. preparation of a reference term to be followed in the project; ⅲ. definition of an evaluation criteria and proposition of taxation incentives for an efficient environmental management; ⅳ. evaluation among governmental departments which one is the most adequate to deal with environmental licensing. Positive results are expected from these propositions, as the whole process will be more agile, creating incentives to the miner implement the mitigation measures.
