STATUS OF IMPLEMENTATION OF THE HWC MACT RULE IN SELECTED STATES

The promulgation of the Hazardous Waste Combustor (HWC) MACT Rule in September 1999 marked a radicalrnchange in how facilities incinerating hazardous waste will be regulated. The HWC MACT will regulate the operationrnof HWCs under the CAA as opposed to RCRA. State regulatory agencies must now determine how to delineate permittingrnand enforcement responsibilities between different divisions or find ways to share resources between programs.rnThis paper discusses how implementation of the HWC MACT was envisioned by EPA, presents some new issues andrnchallenges a state regulatory agency must face to implement the Rule, and provides selected case studies on where certainrnstates are in implementing the Rule.
