In this paper we examine the reasons behind the current sentencing practices, as well as some new approaches in order to improve the effectiveness of alternative criminal sanctions and by default, reducing repeat criminal behavior. The majority of researches that exist on studying behavior of the offenders is dominated by the predilection that identifying risk factors associated with recidivism will benefit the treatment providers. Further, the majority of existing treatments are guided by research that has identified what makes people more likely to reoffend. Absent from the majority of the literature is an examination of the strengths and positive characteristics that may prove useful in both reducing recidivism and increasing the likelihood of achieving positive outcomes, in other words, demonstrating resilience. The view of the author is that an offender can be helped and assisted to his or her re-socialization and reintegration into society, in a process based on resilience. The therapeutic intervention targeting the assisted resilience process of the offender, is a complex process that occurs simultaneously at several levels, based on the dynamics of the emotional conflict he lives. The support and assistance of the offender will be directed toward creating inner availability, and also motivation to change the criminal behavior.
