The guardianship court, which is a category within the judiciary structure that has been beneficially included again in Romanian legislation through the joint provisions of the New Civil Code [hereinafter the NCC] and of the New Civil Procedure Code [hereinafter the NCPC], does not represent an innovation, but it is rather an opportune reactivation of a specialized Court from the point of view of the cases this one investigates, and also, as it would be advisable, of the judges authorized to rule on matters that are not related only to the legality, but often to the opportunity too.
