Research on the Contractual Parties' Sharing Responsibility of Earthquake Risk Based on FIDIC Terms

摘要

This paper analyzes the terms of earthquake risk in FIDIC. It makes more clear definition of some vague concept of the shared risk responsibility in the FIDIC based on the principal of fairness. It will improve the contractual parties' enthusiasm to prevent and control the risk. If the earthquake happens, this can reduce the loss of the project under construction. It provides certain reference to the reasonable share the responsibility of the loss caused by earthquake. It also reduces the dispute between contractual parties. The clear division of earthquake risk responsibilities also provides certain reference to further improve FIDIC terms.
