The right to legal defense exercised by lawyers in the European Union countries

The right to legal defense is a fundamental right that is part of the civil rights and liberties, which are closely related to the individual freedom and individual security of the people. The right to legal defense under the two aspects: material and procedural, in Romania, is regulated by numerous legal norms such as: the Constitution, The Law on judicial organization, the Criminal Procedure Code, the Civil Procedure Code, the Law on the organization and exercise of the legal profession and many other special rules that can be found in all areas of economic and social life (labor law, litigation law, administrative law, intellectual property law, human rights law, etc) Our aim is to become aware of the way in which the right to legal defense is respected in the European Union, by applying the directives that govern the exercise of this profession in the European Union. Through the results of the undertaken research we will make proposals for improving the implementation of this principle, especially on its legal aspect, but most particularly the findings will be useful to practitioners, professors, students of graduate and undergraduate programs in Romania and the other EU countries.
