April 1, 2011 heralded a new era in Canadian imnnigration. There is now an increased focus on program integrity and the protection of foreign workers following the coming into effect of regulatory changes. The following is intended as a general overview of current processes and factors taken into consideration by HRSDC/SC when applying for an LMO or conducting an employer compliance review. In particular, this paper focuses on the analysis undertaken by officers in determining whether a job offer is genuine and whether an employer has provided foreign workers with substantially the same (STS) wages, working conditions and employment in a specified occupation within the previous two years. Guidance is also provided with respect to best practices in developing a corporate compliance strategy.
