On January 2, 2011 the US Environmental Protection Agency (USEPA) began regulating emissions of greenhouse gases (GHG). At the same time developers were completing front-end engineering and designs of projects to expand power generation capabilities and struggling with the uncertainty of rapidly evolving, and in some cases, ambiguous regulations and guidance. Faced with this uncertain permitting environment and with the prospect of setting precedents for GHG BACT, utilities have had to work hand in hand with their consultants and regulators to draft permits that meet regulatory and public expectations while balancing the need for operational flexibility and compliance. This paper will provide practical experience in balancing those needs.
