On November 21st,2005,the State of New Jersey issued a Prescriptive Order for chemical plant security measures to protect against terrorist attacks.Acting Governor Richard J.Godey set new requirements for the 140 facilities that must comply with the Prescriptive Order.Of these 140 facilities,43 of which are subject to the state's Toxic Catastrophe Prevention Act(TCPA)program,and the remainder are subject to New Jersey's Discharge,Prevention,Countermeasures,and Control(DPCC)regulations.As part of the new requirements,the 43 TCPA facilities must review the potential for adopting inherently safer technology(1ST)as part of their assessment.This is very significant for three reasons-it sets precedent for State mandate of security of the chemical industry(along with Maryland and New York),it incorporates the need to evaluate 1ST more widely than any other regulation in the United States,and it forces industry to prove compliance to security 'best practices' they developed.The only other regulation that referenced inherent safety was a county ordinance in Contra Costa County,which had been implemented in 1999.Understanding these implications is the purpose of this paper.
