These frolics of hyperbole serve well to introduce our subject: the relationship of the Endangered Species Act of 1973 (ESA) to climate change and greenhouse gas (GHG) emissions. This chapter will have accomplished the authors' objective if the reader concludes that the common prophetic vision of the two political antipodes quoted above is clouded and that the ESA is not likely to produce their dreaded/desired outcome. Instead, the authors argue that the ESA may be less threatening due to, and more threatened by, climate change, and that an ESA rendered dysfunctional in the face of climate change may threaten both imperiled species and the regulated community.
