Humans have spent the better part of existence on exploring new frontiers. The origin of human life is said to have begun in Africa, yet human curiosity and ingenuity led to human population across the continents. Then it was topographical barriers such as mountains, seas, and deserts that separated Caucasoid from Mongoloid. Humans, maybe not full aware of every risk, undertook to find what was beyond the seemingly endless horizon. The risks inherent in maritime investments gave rise to a body of law that limits the liability of the ship owner or even the crew in the wake of a disaster. Over time, some of those limitations have changed, but they are just that-limitations. As humans seek to send paying passengers to the last foreseeable frontier-outer space-legislatures have provided space flight carriers with a golden ticket in the form of exculpation from liability. This paper discusses the legal consequences of federal and F waivers of liability in Florida as well as federal law for the sake of commerce as it is applied to the seemingly unprotected space tourist.
