Research on the Investment and Construction Contract Condition of BT Projects

摘要

As a new type of financing mode, BT (Build-Transfer) mode is increasingly applied in infrastructure projects these years. On one hand, it alleviates the shortage bottleneck of government funds on infrastructure construction. On the other hand, it opens a new investment channel for enterprises. However, BT mode in China is still in its early age, there are no corresponding laws which bring many problems in practice, especially in the selection of contract type, risk allocation and the determination of buy-back program. These are the key issues of the investment and construction contract of BT projects. This paper tries to analyze these problems and give some suggestions accordingly which will promote the universal and standardization of the investment and construction contract of BT projects.
