PERFORMANCE-BASED DESIGN REGULATION: CHALLENGES FACED AND LESSONS LEARNED

Although a large majority of buildings designed and constructed under performance-based systems areperforming as intended, there is concern by some that the health and safety performance of others arelacking, that large numbers of people may be at risk, and that the situation would have been better under aprescriptive system. In reality, there will always be some buildings that do not perform as desired,regardless of whether designed and constructed under prescriptive- or performance-based systems. Thoseattributes which define ‘good’ and ‘bad’ performance are not necessarily functions of the regulation, thedesign methods, or of the materials used, but of how the regulatory system works holistically to deliverthe expected or desired performance and how risks associated with innovative methods and materials areaddressed within the system. Drawing from a sampling of diverse cases, a range of challenges that havebeen observed with performance-based regulations and design approaches over the past twenty years areoutlined along with a range of ‘lessons learned.’
