Research on the legal claim in large-scale mechanical and electrical engineering in construction project

Research on the claim is based on the contractor's claims for compensation to the owner, however, the legal status of the owner and contractor are equal in the construction project. The contractor has the right of claim to the owner. The owners also claim for compensation to the contractor. However, the owner's claim is not a simple matter. In this paper, from the legal basis for claims, by studying the theories about contract and claim, combined with the characteristics of large mechanical and electrical engineering project, the author preliminarily discusses the theoretical system of the owners' claim in mechanical and electrical engineering project and its solutions which has a certain theoretical and practical significance. In the large-scale engineering project construction, project quality is one of the focuses of the owners concerned. In essence, influence on the quality of the owners is not quality problem itself, but the quality problem of the consequences to the owners. Because the owners' purpose of the project construction of large-scale mechanical and electrical engineering is designed to make the system have some functions and to get some benefit, the description on the quality of an electromechanical system is not only limited during the construction of it, but should also focus on the system of the whole life cycle. Because a number of projects did not reach the expected effect for various reasons, and was even a complete failure, if our business can't put forward the corresponding claim, we will suffer serious economic losses.
