Legal Issues of E-commerce and Their Countermeasures in China

Currently, great development has been achieved in China’s e-commerce, but many obstacles still exist in its legal system. This article studies China’s current legal system concerning e-commerce from the actual situation of the development of China’s e-commerce, analyzes major characteristics of the legal system of e-commerce and concludes that China’s e-commerce mainly has following legal issues: lack of legal basis for when an electronic contract takes effect; no legal guarantee for security of electronic transaction; insufficient legal protection on intellectual properties in e-commerce environment. The article proposes to perfect the legislation system of e-commerce and conceives of detailed legal system of e-commerce.
