The federal Resource Conservation and Recovery Act (RCRA) of 1976 has been inexistence for more than 25 years. This panel, comprised of regulatory, industry, andservice sector representatives, will address current challenges of the RCRA program andnew developments that could result in significant changes to the existing program.Scott Sherman, Associate Assistant Administrator in the U.S. Environmental ProtectionAgency's Office of Solid Waste and Emergency Response in Washington, D.C., willpresent a discussion of EPA's proposed changes to RCRA's definition of solid waste,including its implications for recycling and reuse of secondary materials. Mr. Shermanwill also provide updates on other developments and agency initiatives in the RCRAprogram.Elizabeth Hurst, General Counsel in the Environmental and Litigation Section forTronox, LLC (world's third-largest producer and marketer of titanium dioxide pigmentwith customers in more than 100 countries), based in Oklahoma, will provide case studiesdemonstrating the challenges of complying with RCRA requirements, particularly in thearea of recycling and reclamation.Cindy Smiley, environmental attorney with Kelly Hart & Hallman LLP in Texas, willprovide a historical perspective of the current RCRA rules and regulations, providing abasis for discussing the applicability of the original RCRA program with today's issuesand challenges.In addition to coverage of the topics described above, the panelists will conduct aninteractive discussion and invite questions from the audience.
