This study is sought to determine the influence that exists in the claim liability in road traffic safety and accident prevention in Spain. The influence of the work is studied in the claim for liability of roads, road safety and the prevention of accidents in Spain.The claim liability process reflects the statistics of accidents or incidents in which the roads are direct or indirect factors due to its inadequate design. These influences establish the degree of involvement of road infrastructure, which has been invested in the repair structure. Furthermore, the user indemnifies the injured and how much has been invested in road safety to prevent future accidents. A lack of information on these types of accidents can cause an incorrect estimate of the magnitude of the problem, which can lead to making improper decisions on road safety measures, planning and resource utilization, and an understanding of these aspects would be a useful measure on the level of services provided by the government. The role of the civil engineer in safeguarding the road assets is valued, his work has become the basis for establishing preventative, well-planned measures, in favor of road safety.
