The knowledge of Alternative Dispute Resolution in Sarawak, Malaysia

Alternative Dispute Resolution (ADR) is a term that covers a variety of different ways of facilitating the resolution of disputes without recourse to the courts. It can involve different processes and can be triggered by different events in different countries. There are various ADR mechanisms available, including mediation, conciliation, adjudication, expert determination, early neutral evaluation and mini-trials (Morgan, 2008). Although ADR was traditionally perceived by many as being limited to arbitration, this perception is slowly changing. The purpose of this research is to identify the preliminary finding on the awareness of contractors registered under PKK Class A in Sarawak towards ADR. Questionnaires were distributed and the data was analyzed using SPSS. From the research, most of the contractors have a clear picture about ADR through printed resources such as magazine produced by Malaysia Builders, newspapers and etc. The study also reveals that most of the contractors agree that ADR will protect the confidentiality of the dispute and provide better privacy for the dispute parties to resolve the dispute.
