Accessing Patent Values in Patent Infringement Lawsuits: a Case of Chinese Study

A quantitative patent valuation model was proposed based on the Chinese court patent infringement lawsuits.Firstly,a patent indicator system of 14 indicators was built.Then,30 Chinese court patent infringement penalty cases were collected as the assessment of reference values.And the multi-regression analysis and the neural network simulation analysis were used to study the linear and nonlinear relationship between the indicator system and the penalty amount of the sample lawsuits to build a patent valuation model for the assessment of patent value.Numerical simulation analysis shows that the simulation model by neural network analysis has better explanatory power,applicable to the assessment of the value of Chinese patent.Based on these results,a quantitative patent value valuation model has been proposed,which is especially suitable for determining the value of a patent when facing a potential risk of patent infringement.
