Florida Update on Rechargeable Batteries

Although Florida law requires product stewardship for rechargeable ni-cd and SSLA batteries, the DEP commends the cooperative attitude which many battery manufacturers and marketers have shown. Many companies are participating in the industry-wide RBRC recycling program. Others have established their own individual rechargeable battery unit management programs. It appears that industry-sponsored programs are most cost effective and that many companies prefer this RBRC-type approach. The DEP concurs and encourages other industry-wide programs for SSLA and other types of batteries. Recently, the DEP has contacted battery manufacturers and marketers that have not yet demonstrated compliance with Florida law. Many companies have responded and have demonstrated compliance or are developing programs. In order to ensure that all rechargeable battery manufacturers and marketers are meeting their product stewardship responsibilities, the DEP will soon provide major retailers that purchase rechargeable batteries and products with a list of companies that have complied with Florida law. A separate list of battery marketers and manufacturers that have not complied with Florida law will also be provided. Per Florida law, marketers and manufacturers that have not complied may not sell, distribute or otherwise offer for sale ni-cd or SSLA batteries or products in Florida. The DEP will request that retailers refrain from purchasing rechargeable ni-cd and SSLA batteries or products from companies that have not complied with Florida law. The DEP expects that this combination of cooperation from the battery industry and regulatory pressure on companies that have not yet met their responsibilities will bolster the beneficial environmental impact of product stewardship for rechargeable batteries.
