The present invention relates to a method and system for processing multiple instances of data using gain control based on noise energy. The signal 100 is transmitted from the base station and received by the subscriber unit 104 in accordance with the associated noise energy. The non-orthogonal noise energy associated with the signal 100 transmitted to the subscriber unit 104 is measured, and the gain of the signal is adjusted so that the non-orthogonal noise energy is set to a predetermined level. If multiple instances of signal 100 are received by subscriber unit 104, the signal is separated and the non-orthogonal noise associated with each signal is measured separately. In a preferred embodiment the non-orthogonal noise measurement is performed by the low energy channel assistance 308 within the forward link signal 100 which is performed according to the code division multiple approach signal processing technique. The reference value is then divided by the result of this demodulation 308 to calculate the control signal 320 used to adjust the gain of the signal associated with the second highest energy channel in the forward link signal. The reference value can be generated through the use of stored information, or through the measurement of another signal that is pre-adjusted to a more optimal energy level.
