PROBLEM TO BE SOLVED: To provide an operator discriminating method and an operator- discriminating device capable of discriminating the occupant sitting on which seat of a vehicle has operated a controller, etc., of an on-vehicle device. SOLUTION: An inner mirror for the vehicle is provided with a CMOS camera 46 via which the arm of the occupant operating the controller 38 is imaged. Image data obtained by the image is subjected to enhancing, erasing and extracting processing by an image processing control part 42, as well as discriminating processing. With these processes pixels estimated as the arm of the occupant on a front passenger seat among the constituting the image data are left, and when the remaining pixels are discriminated as the arm of the occupant on the front passenger seat, the occupant operating the controller 38 is discriminated as the occupant on the front passenger seat.
