PPROBLEM TO BE SOLVED: To execute the configurations of a modeling data generating method and a portrait right violation judging device for generating modeling data associated with a new person without violating the right of a person owning a portrait right, and for easily executing contents manufacture by using the data. PSOLUTION: The modeling data of a person to be judged which are associated with the length of each site of the body and length between each site of the body of a person to be judged related with the expressions of the manufactured human face and body having prescribed facial and body shapes are compared with the modeling data of a person claiming the portrait right stored in a portrait right owner site data base 42, and the similarity of the modeling data is detected by a similarity measuring means 43, and when the detected similarity exceeds a prescribed threshold, a portrait right violation warning signal is generated by a threshold comparator 46 so that a portrait violation judging device can be constituted.
